Minor Variances
Zoning bylaws govern the type of use permitted on a property and lists minimum development requirements. If your construction or renovation project has been denied a building permit, zoning certificate of occupancy or is unable to comply with the provisions of the zoning by-law, you can apply to the Committee of Adjustment for a minor variance.
The minor variance application process is a method to seek relief through the Committee of Adjustments when circumstances do not allow you to meet the standards listed in the bylaw. Examples of minor variances include relief from certain parking space requirements, building setbacks and height restrictions.
Minor Variances may be granted provided that, in the opinion of the committee:
- The request is minor in nature,
- The request is desirable for the appropriate development or use of the land, building or structure, and
- The general intent and purpose of the zoning bylaw and the Official Plan are maintained.
